  3. Original divorce documents, if applicable (Certificate of Divorce Form 36B).

Each partner must submit two (2) pieces of acceptable identification (ID):

Identification must be VALID (not expired) and ORIGINAL (Photocopies will not be accepted).

The name on both pieces of your ID must be the same.

The first name and last names must match on the two pieces of ID you are presenting. If your ID is not in English, a written translation from a certified translator is required.

  • Canadian Citizenship Card with photo

Please note that a marriage licence will NOT be issued without 2 pieces of valid identification (as outlined above) from each applicant. One of these pieces of identification MUST confirm your citizenship.

One party to the marriage (applicant or joint applicant) may submit the completed application form to the Clerk's Office in order to obtain the Marriage Licence, provided that appropriate identification is submitted for both parties.

There is no waiting period for a marriage licence. The licence is valid immediately once issued. A Marriage Licence is valid anywhere in Ontario for 90 days from the date it is issued. Should the 90 day period expire, another licence must be purchased. No refunds can be provided for marriage licences issued.

Applicants aged 16 and 17 must have the written consent of their parents. Further information with respect to these situations is available from the Clerk's Office.

Within Canada:  Applicants who have been divorced within Canada are required to produce either the original or a certified copy of the Decree Absolute (if divorced before 1986) or Certificate of Divorce. Certification may be obtained through the Courts.

A Final Judgment or Divorce Order is not Acceptable.

The Divorce Order (Divorce Judgment) is not proof that you are legally divorced because there is usually a 31 day waiting period after the divorce has been granted before it will take effect. The Court will not issue a Divorce Certificate until the waiting period has elapsed and the divorce has taken effect.

Outside Canada: Applicants who have been divorced outside of Canada are required to follow a different process in order to ensure that their divorce is honoured in this Country. Please visit the Service Ontario website for further information.

Applicants who are widowed are not required to provide proof of the death of their spouse.

After the ceremony, the person who performed your wedding provides you with a record of solemnization as a keepsake. This is not a marriage certificate.

You may apply for a marriage certificate from Service Ontario 8 to 12 weeks after your marriage ceremony. Couples can complete a Marriage Certificate Application and mail it directly to the Registrar General's office or request the Marriage Certificate online at Service Ontario.
